General Terms and Conditions for the Purchase of Tickets for DIGITAL X

1. Contracting Party

Your contractual partner is Deutsche Telekom Geschäftskunden GmbH, Landgrabenweg 149, 53227 Bonn (Bonn District Court 19168).

2. Conclusion of Contract

  1. The customer can order tickets for DIGITAL X in our online shop. When the customer places an order, they submit an offer to us to conclude a corresponding contract. The customer is bound by their offer for a period of two working days. Within this period of time, we can declare acceptance of the offer, which is usually done by successfully completing the payment process, executing the order, or confirming the conclusion of the contract in text form.
  2. If you are a consumer within the meaning of § 13 BGB, you must have reached the age of 18 when placing your order. If we learn after the conclusion of the contract that you have not reached the age of 18, we are entitled to withdraw from the contract.

3. Returns, Transferability, Delivery and Shipping, Invoice

  1. Tickets can only be returned if you are legally entitled to do so or if we do not hold the DIGITAL X or postpone the dates. The tickets are personalized and cannot be transferred to third parties.
  2. We will deliver to the email address provided by the customer when placing the order.
  3. The invoice will be sent by email.

4. Cancellation of DIGITAL X

We are entitled to cancel the event, especially for good cause.

5. Further Offers for DIGITAL X

6. Non-Existence of a Right of Withdrawal

For the purchase of tickets for DIGITAL X on a specific date or period, there is no statutory right of withdrawal for consumers according to § 312 g para. 2 sentence 1 no. 9 BGB.

7. Liability

  1. In the event of intent or gross negligence as well as in the absence of a guaranteed property, Telekom shall be liable without limitation.
  2. In the event of slight negligence, Telekom shall be liable without limitation in the event of injury to life, limb, and health. In addition, in the event of slight negligence, Deutsche Telekom is only liable if an obligation is violated, the fulfillment of which makes the proper performance of the contract possible in the first place, the breach of which jeopardizes the achievement of the purpose of the contract, and on whose compliance the customer can regularly rely (cardinal obligation). In the event of a breach of a cardinal obligation, liability is limited to the foreseeable damage typical of the contract. This also applies to lost profits and lost savings. Liability for other removed consequential damages is excluded.
  3. Liability for all other damages is excluded. Liability under the Product Liability Act remains unaffected.

8. Own Sound, Video, and Photo Recordings

You are prohibited from making your own audio, video, or photo recordings at the events to which you gain access with the purchased ticket.

9. Out-of-Court Dispute Resolution

  1. The EU Commission has provided a platform for out-of-court dispute resolution at the address http://ec.europa.eu/consumers/odr/.
  2. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

10. Miscellaneous

  1. We are entitled to provide the services through third parties. We are liable for the provision of services by third parties as well as for our own actions.
  2. You may only transfer the rights and obligations arising from this contract to a third party with the prior written consent of Deutsche Telekom.
  3. Telekom is entitled to transfer the rights and obligations arising from this contract to Deutsche Telekom AG, Friedrich-Ebert-Allee 140, 53113 Bonn (Bonn District Court HRB 6794), Telekom Deutschland GmbH, Landgrabenweg 151, 53227 Bonn (Bonn District Court HRB 5919) or to any other third party without your consent. In the event of a transfer to an unnamed third party, you have the right to terminate the contract with Telekom without notice.
  4. German law shall apply to the contract, unless indispensable statutory provisions applicable to the place of residence of the customer who is a consumer take precedence.
  5. If you are a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction for all disputes arising from or in connection with this contract is Bonn. Any exclusive place of jurisdiction shall take precedence.
  6. Should individual provisions of these General Terms and Conditions be or become invalid in whole or in part, the remaining provisions shall remain unaffected, unless the omission of individual clauses would put a party to the contract at such an unreasonable disadvantage that it can no longer be expected to adhere to the contract.
